A deferred acceptance of a plea includes the provision that if all conditions of the sentence are met, the court shall later dismiss the charge against the defendant.
c Robin Gari McIntyre, 47, of Kailua-Kona, pleaded guilty Aug. 5 to second-degree promoting prison contraband and third-degree theft. She was sentenced Feb. 2 to five years probation with conditions that she pay $2,379.96 in fines, fees and restitution and serve 18 months incarceration with credit for time served.
c Rowell Padillo Jadraque, 35, of Kailua-Kona, pleaded no contest Dec. 12 to possessing drug paraphernalia. He was sentenced Feb. 6 to five years probation with conditions that he pay $1,755 in fines and fees and serve one year incarceration, with credit for time served and all remaining time suspended.
c Orion Jaegar, 22, of Captain Cook, pleaded guilty Feb. 8 to third-degree promoting a detrimental drug. He was sentenced to six months probation with conditions that he pay $355 in fees, perform 50 community service hours, and obtain or maintain full-time work or enroll in an educational or vocational training program.
c Randall Hatori, 37, of Kailua-Kona, pleaded guilty Feb. 9 to abuse of a family or household member. He was sentenced to two years probation with conditions that he serve intermittently 180 days incarceration, with credit for time served and all but 15 days suspended, pay $205 in fees, obtain or maintain full-time work or enroll in an educational or vocational training program, provide DNA and print impressions to police, and write a letter of apology to the victim.
c Randolph John Juszczak, 51, of Ocean View, pleaded guilty Feb. 14 to third-degree assault. He received a one-year deferred acceptance of his plea with conditions that he pay $434.17 in fees and restitution, serve six months incarceration, with credit for time served and all remaining time suspended, obtain an anger management assessment, obtain or maintain full-time work or enroll in an educational or vocational training program, and write a letter of apology to the victim.
c Shawn Kealoha Dela Cruz, 19, of Kailua-Kona, pleaded guilty Nov. 28 to abuse of a family or household member and second-degree terroristic threatening. He was sentenced Feb. 16 to two years probation for the abuse offense and one year probation for the threatening offense with conditions that he pay $26O in fees, serve 90 days incarceration, with credit for time swerved and all but 30 days suspended, obtain or maintain full-time work or enroll in an educational or vocational training program, complete his GED, and write a letter of apology to the victim.
c David L. Steele, 38, of Kailua-Kona, pleaded guilty Feb. 16 to failure to comply with lawful order of a police officer and two counts criminal contempt of court. He was sentenced to two years probation for the failure to comply offense with conditions that he pay $205 in fees, and serve 30 days incarceration, with credit for time served and all remaining time suspended. For the contempt offenses, Steele was ordered to pay $130 in fees and serve 30 days incarceration, with credit for time served.
c Allen Wallace King, 58, of Kailua-Kona, pleaded guilty Feb. 15 to two counts felony abuse of a family or household member and second-degree terroristic threatening. He was sentenced Feb. 22 to five years probation for the abuse offenses and one year probation for the threatening offense with conditions that he pay $915 in fees, and serve consecutively 11 months incarceration for the abuse offenses and six months incarceration for the threatening offense with the stipulation that all but 11 months shall be suspended should he enter a therapeutic living substance abuse program. He must also enter a domestic violence intervention program, obtain a mental health assessment and write apology letters to the victims.
c Julio Cesar Henao-Restrepo, 60, of Kailua-Kona, pleaded guilty Feb. 23 to habitually operating a motor vehicle under the influence of an intoxicant and third-degree promoting a detrimental drug. He was sentenced to five years probation for the drunken driving offense and six months probation for the drug offense with conditions that he pay $2,217 in fines and fees, serve 11 months incarceration for the drunken driving offense and five days for the drug offense, with credit for time served and all but 30 days suspended. He must also obtain full-time work or enroll in an educational or vocational training program, provide DNA and print impressions to police and not operate a motor vehicle or seek a license for one year.
c Jon Kilauea Donner, 30, of Kailua-Kona, pleaded guilty Feb. 16 to two counts third-degree theft. He was sentenced Feb. 23 to one year probation with conditions that he serve 30 days incarceration, with credit for time served and all remaining time suspended, pay $497.96 in fees and restitution, and write letters of apology to the victims.
c Alexander Paofe Togi, 26, of Kailua-Kona, pleaded guilty Feb. 24 to second-degree assault. He was sentenced to five years probation with conditions that he pay $2,077 in fees, fines and restitution, serve one year incarceration with credit for time served and all but 60 days suspended, complete a domestic violence intervention program, complete a parenting program, and write a letter of apology to the victim.
