Hawaii Supreme Court Chief Justice Mark Recktenwald issued an order allowing the state’s circuit courts to resume jury trials starting Sept. 1, “barring further public health or other extraordinary developments that would make doing so imprudent.”
All trials are to comply with social distancing mandates in Gov. David Ige’s COVID-19 emergency proclamations “and shall be conducted in a manner that ensures the safety of court users,” Recktenwald ordered.
Rules on courthouse closures and entering of Judiciary facilities are extended through July 31, with some exceptions.
Interim Third Circuit Chief Judge Melvin Fujino said the Big Island Judiciary is looking at ways to accommodate jury trials in a manner consistent with COVID guidelines for both jury selection and jury trials. The use of video conferencing is being looked into for jury selection, as well as an expanded jury questionnaire.
Grand jury proceedings will resume July 1 with special consideration given to social distancing.
