A 35-year-old Hilo woman was sentenced Thursday to probation and jail after she pleaded guilty to theft, promoting a dangerous drug and possessing drug paraphernalia.
3rd Circuit Court Judge Glenn S. Hara sentenced Gayleen Oda to five years probation with conditions that she serve one year in jail with the possibility of release to a residential drug treatment program and pay a mandatory shoplifting fine of $1,386, according the Hawaii County Office of the Prosecuting Attorney. Oda pleaded guilty to second-degree theft, third-degree promotion of a dangerous drug and possession of drug paraphernalia.
Police investigation revealed that on Dec. 24, 2011, Oda entered a Hilo retail store, stuffed merchandise into a baby stroller and left the store with merchandise valued at $346.50, according to the office. She was caught leaving the store by loss prevention agents and held until police arrived. Following her arrest, a police search located methamphetamine and drug paraphernalia in her possession.
All three offenses Oda pleaded guilty to are class C felonies punishable by up to five years in prison and a $10,000 fine for each offense, according to the office. If a defendant shoplifts property valued over $300, a mandatory fine equal to four times the value of the property is assessed. The mandatory fine is double that for a subsequent offense.
