HONOLULU — Attorney General Doug Chin joined 22 state attorneys general Tuesday in filing a multistate lawsuit to block the Federal Communications Commission’s illegal rollback of net neutrality.
The coalition filed a petition for review in the U.S. Court of Appeals for the D.C. Circuit, formally commencing the lawsuit against the FCC and the federal government.
“Big business must not be deciding what people in Hawaii can access on the Internet and how easily we can access it,” Chin said in a press release. “This lawsuit challenges the rushed attempt, riddled with irregularities, by the Trump Administration to rollback net neutrality.”
He said the repeal of net neutrality would have dire consequences for consumers and businesses in Hawaii and across the country that rely on a free and open internet — allowing internet service providers to block certain content, charge consumers more to access certain sites, and throttle or slow the quality of content from content providers that don’t pay more.
Under the Administrative Procedure Act, the FCC cannot make “arbitrary and capricious” changes to existing policies, such as net neutrality, the release stated. The FCC’s new rule fails to justify the Commission’s departure from its long-standing policy and practice of defending net neutrality, while misinterpreting and disregarding critical record evidence on industry practices and harm to consumers and businesses.
The lawsuit is led by New York Attorney General Schneiderman, and joined by the attorneys General California, Connecticut, Delaware, Hawaii, Illinois, Iowa, Kentucky, Maine, Maryland, Massachusetts, Minnesota, Mississippi, New Mexico, North Carolina, Oregon, Pennsylvania, Rhode Island, Vermont, Virginia, Washington, and the District of Columbia.
The article states that the recension of net neutrality is illegal. Is not that untrue? Hawaii is once again the servant of lies to argue the totalitarian case.
The only thing illegal was the imposition of “Net Neutrality” (which, lets face it, was anything but…) in the first place…
Careful HI I would like to keep my connectivity in Kona. Internet connectivity is not a God Given right and the Military could just take the whole damn thing from us and then we have to lay our own pipe. These lawmakers (or so called lawmakers) really should focus on the important things our state needs and not trying to make a name for themselves!
