HAGATNA, Guam — A Guan inmate says the Department of Corrections violated his Eighth Amendment rights when officers failed to provide him with medical care.
The Pacific Daily News reports the lawsuit filed in the District Court of Guam seeks $25,000 for emotional stress and another $25,000 in punitive damages.
Inmate Francisco Arias filed the lawsuit Friday saying his toe is disfigured from a bone fracture that was left untreated for too long, and his diabetes and blood pressure medications still aren’t being filled in a timely manner.
The prison was ordered by a judge in January to fix ongoing problems with its medical, mental and dental health care issues.
Arias has another lawsuit pending against the DOC, asking for $1,400 in damages for mail Arias says was thrown away.
