A 28-year-old Kona man was sentenced on Friday to 20 years incarceration in connection with a 2023 crime spree involving a stolen car, robbery and firing a weapon at a law enforcement officer.
Dylan Alcain, along with his wife Leilani, were charged with a litany of crimes that started with a robbery at a Waikoloa Village gas station on April 14, 2023. Arriving officers determined that forceable entry was made into the business through a rear door and $250 in cash had reportedly been removed. Video surveillance footage showed a gray-colored BMW sedan arrive and park in the area. A man, later identified as Alcain, is seen carrying a rifle and walking towards the rear door, accompanied by a woman, who could not be positively identified at the time. The BMW sedan was then seen fleeing the area. Six days later, the spree continued with a series of crimes starting with an early morning break-in of the Hele Gas Station on Kanalani Street where the glass front door was broken and an undisclosed amount of cash was stolen. Police obtained video surveillance which showed a gray-colored BMW sedan with a female operator, later identified as Leilani Alcain, pull into the area and Dylan Alcain get into the passenger seat.
A little over two hours later, a second break-in was reported at the Hele Gas Station in Kealakekua. As officers were responding to the scene, Officer Gyasi Williams’ police subsidized vehicle was shot at with rounds striking his front windshield as the BMW fled the scene, traveling at a high rate of speed in the opposite direction.
Officers pursued the BMW, attempting to stop the occupants. While in pursuit, Dylan Alcain fired upon Officers Troyson Reilly and Charles Caldwell-Kaai. None of the officers were injured and the chase was called off for safety reasons.
But that did not stop the couple from allegedly continuing their spree.
Less than an hour later, police responded to a report of an armed robbery at a Captain Cook residence located on Huna Kai Road. A male victim reported that a man with a rifle and a female accomplice threatened him and demanded the keys to his red Ford Explorer SUV. The couple then fled the area in the SUV. A gray-colored BMW sedan was found abandoned near the area.
Later that morning, the couple was arrested without incident after being located at a Volcano residence.
“We are extremely fortunate that no officer died during this incident,” said Police Chief Benjamin T. Moszkowicz at the time of their arrest.
On April 25, 2023 Dylan Alcain was indicted on 12 counts including first-degree theft, first-degree unauthorized control of a propelled vehicle, first-degree robbery, first-degree attempted murder, first-degree terroristic threatening, first-degree resisting an order to stop, first-degree criminal property damage, two counts of second-degree burglary, possession of a loaded firearm on a public highway and first-degree burglary. His bail was set at $725,000
On Feb. 1, 2024, a complaint superseding the indictment reduced the attempted murder charge to first-degree terroristic threatening and Dylan Alcain changed his plea to guilty to first-degree robbery for the robbery of the Ford Explorer at gunpoint, two counts of second-degree burglary for breaking into the Hele gas stations, two counts of first-degree terroristic threatening involving the police officers, first-degree criminal property damage for damaging the windshield of a subsidized police vehicle, and first-degree resisting an order to stop for fleeing from police. All other charges were dropped.
First-degree robbery, the most serious charge, carries a 20-year prison term. First-degree criminal property damage carries a penalty of 10-years, and the remaining charges carry a five year sentence. Circuit Court Judge Wendy DeWeese ordered the sentences to run concurrently with credit for time already served.
Alcain’s wife, Leilani Alcain, remains in custody on $700,000.00 bail for 11 related charges. Her trial is currently scheduled for August 6, 2024.
